Determining Property Tax Through Self-Assessment

Property tax is calculated from the moment the tax liability arises and is payable for each tax year as long as the liability exists. Taxpayers who maintain accounting records are required to determine their own property tax liability for real estate located in the Republic of Serbia through the self-assessment procedure prescribed by law.
The property tax return for a given tax year must be submitted no later than March 31 of that year. The return must be filed with the competent local tax authority in the municipality where the property is located.
Where a taxpayer owns several properties within the territory of the same local self-government unit, a single tax return is submitted covering all such properties. If the properties are located in different municipalities, separate tax returns must be filed with each competent local authority.
Real Estate Subject to Property Tax
Property tax applies to real estate located in the Republic of Serbia where ownership rights, possession rights, usage rights, or other legally recognized rights constitute a basis for taxation.
When determining the tax liability, several important issues should be considered. First, it is necessary to establish whether a particular asset qualifies as real estate under applicable regulations. It is also important to determine which rights over the property give rise to the tax obligation and who should be considered the taxpayer.
Furthermore, attention should be paid to identifying which structures and facilities are regarded as integral parts of the land and therefore included in the property tax base. Special consideration should also be given to properties that have not yet been formally registered in the real estate cadastre but are undergoing registration procedures in accordance with the regulations governing the recording of ownership rights. The absence of a formal cadastral registration does not necessarily eliminate the obligation to pay property tax, and each situation should be assessed based on its specific facts and applicable legal provisions.
